When you create an account or use the Service, we collect information you provide directly, including your username and password, and, where you choose to provide them, your display name, email address, phone number, and profile photo.
We collect the content you submit through the Service, including post descriptions, categories, prices, photographs, and messages exchanged with other Users (“User Content”).
The Service is built around connecting Users within a defined local area. We collect location information, including the location associated with your account and the location associated with each post you create, in order to show you and other Users content relevant to your area and to calculate distance between Users and posts. You may be asked to grant location permissions on your device to enable these features.
Your selected display language is stored on your device and, where applicable, transmitted to our servers to determine which language your content and interface are shown in. It is not otherwise retained as part of your permanent account record on our servers.
When you use the Service, we and our service providers may automatically collect certain information, including your IP address, device and app version information, and records of your activity within the Service (such as posts viewed, searches performed, and general usage patterns), for purposes including security, analytics, and abuse prevention.
If you use the Service without creating an account, we may still collect limited technical and location information necessary to display relevant content to you, as described in this Policy.
Certain posts on the Service may be shared as a public web page accessible to anyone with the link, including individuals who have not installed the application or created an account. When a visitor accesses such a page, we automatically collect limited technical information, including IP address, browser or in-app user-agent information, the specific post viewed, and, where the link includes a referral identifier, information about where the link was shared. This information is used to measure how sharing drives interest in the Service and is not linked to a User account unless the visitor subsequently creates one.
Where a User confirms that a transaction relating to a post occurred, we record that confirmation, including the time it occurred and the identities of the Users involved. A cumulative count of confirmed transactions is displayed on the relevant post and associated with the posting User’s account, and is visible to other Users of the Service, as described in Section 4.1.
We use the information we collect to:
Posts and, where applicable, messages submitted through the Service are processed by automated systems, including artificial-intelligence-based tools, for the purpose of detecting content that violates our Terms of Service, including but not limited to sexually explicit material, violent content, and content involving the exploitation of minors. This processing may be performed by us or by third-party service providers acting on our behalf. Content that is flagged in this process may be reviewed by authorized personnel.
Where you request or are shown a translation of another User’s post, the underlying text is processed by automated translation systems, which may be operated by a third-party service provider, in order to generate the translated text displayed to you.
Where content is identified as apparent child sexual abuse material or other content we are legally required to report, applicable law requires us to report such content, together with associated account and technical information such as IP address and timestamp, to the National Center for Missing & Exploited Children (NCMEC) and, where applicable, to law enforcement. Content subject to such a report may be preserved for a period required by applicable law, independent of any deletion of the associated post, message, or account.
Certain information is inherently visible to other Users as part of using the Service, including your username, display name, profile photo, posts, your cumulative count of confirmed transactions as described in Section 1.8, and approximate distance from other Users, and, where you initiate contact, your messages with the User you are communicating with.
We share information with third-party service providers who perform services on our behalf, including hosting and database infrastructure, image and file storage, content moderation and translation processing, and communications delivery (such as sending one-time passcodes). These providers are authorized to use your information only as necessary to provide services to us.
We may disclose information where we believe in good faith that disclosure is necessary to comply with applicable law, regulation, legal process, or governmental request; to report suspected illegal content, including to NCMEC as described in Section 3.3; to enforce our Terms of Service; or to protect the rights, property, or safety of the Company, our Users, or the public.
If the Company is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to standard confidentiality arrangements.
We do not sell your personal information to third parties for money. Where applicable law defines certain sharing arrangements (such as with service providers described above) as a “sale” or “share” under its own broader definition, your rights with respect to such sharing are described in Section 7.
We retain your account information for as long as your account remains active. If you delete your account, we delete your account information and associated posts, and remove your identifying information from messages you have sent, retaining only the underlying message content where necessary to preserve the message history of the other participant in a conversation. Content that has been reported and is subject to a legal preservation obligation, as described in Section 3.3, is retained independently of account deletion for the period required by law. Aggregated or de-identified analytics information may be retained after account deletion in a form that does not identify you.
You may review and update your account information, including your display name, email address, phone number, and profile photo, at any time through the Service’s account settings.
You may block another User at any time, which prevents that User from contacting you further, and you may manage your blocked-user list through the Service’s settings.
You may change your display language at any time through the Service’s settings.
You may permanently delete your account at any time through the Service’s account settings. Account deletion is permanent and cannot be undone, and results in the deletion of your account information and posts as described in Section 5.
You may control location permissions for the Service through your device settings. Declining or revoking location permissions may limit or disable core features of the Service that depend on location, such as displaying nearby posts.
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, “CCPA”), provides you with certain rights regarding your personal information, including the right to know what personal information we collect, use, and disclose; the right to request deletion of your personal information; the right to correct inaccurate personal information; and the right to non-discrimination for exercising your rights. You may exercise these rights by contacting us as described in Section 12, or, where applicable, through the account deletion and account update features described in Section 6. We do not sell personal information for money as described in Section 4.5.
The Service is not directed to, and is not intended for use by, individuals under eighteen (18) years of age, consistent with the eligibility requirements in our Terms of Service. We do not knowingly collect personal information from individuals under eighteen (18). If we become aware that we have collected personal information from an individual under eighteen (18), we will take steps to delete such information. If you believe a child under eighteen (18) has provided us with personal information, please contact us as described in Section 12.
We use administrative, technical, and physical safeguards designed to protect information collected through the Service, including encryption of passwords and secure storage of authentication credentials. No method of transmission or storage is completely secure, and we cannot guarantee the absolute security of any information.
The Service may reference or link to third-party websites or services, and may rely on third-party service providers as described in Section 4.2. This Policy does not apply to, and we are not responsible for, the privacy practices of any third party.
We may revise this Policy from time to time. The revised Policy will become effective as of the “Last Updated” date shown at the top of this page. Your continued use of the Service after any such revision constitutes your acknowledgment of the revised Policy.
Questions about this Policy, or requests regarding your personal information, may be directed to info@orchardbrk.com.
